“The Prudent Investment Adviser Rules” (“Rules”) was a manual written in 2003 for investment adviser consulting clients of the The Watkins Firm,  a law firm located in Atlanta, Georgia.  The “Rules” was a compilation of information that had been provided to the firms’ clients through advisory alerts and our newsletter.

The criteria set out in the “Rules” is based on regulatory rulings and judicial decisions that have effectively created liability standards for investment advisers.  The “Rules” is a “living” document that continues to develop as new rulings and decisions are handed down.  “The Prudent Investment Adviser Rules” blog is is intended to share information regarding “best practices” and liability trends within the investment advisory industry, as well as promote discussions regarding such issues.

The “Prudent Investment Adviser Rules” blog is a project of The Watkins Firm, a law firm that provides services to both investors (individuals, trusts, foundations, pension plans) and investment advisory firms.  Among the services provided are forensic analysis of financial plans and investment portfolios to determine the suitability of such plans and portfolios.  Investment advisory services include mock SEC/state audits, development and implementation of advisory risk/liability management programs, analysis and drafting of Form ADV, and legal services covering the initial set-up of investment advisory firms, including the preparation of required regulatory manuals.  We also various professional presentations for investment adviser groups, including our popular presentation,”The Prudent Investment Adviser Rules,” which discusses strategies that investment advisers should use to better protect their practices. 

The Founder of The Watkins Firm is James W. Watkins, III.  Mr. Watkins is an honors graduate of Georgia State University and a graduate of the the University of Notre Dame Law School.  He has been an attorney since 1981 and is a member of the Fiduciary Section of the State Bar of Georgia.  He has extensive experience in the areas of fiduciary law, securities/investment law, financial planning, asset protection/wealth preservation planning, and estate planning.  He has earned both the CERTIFIED FINANCIAL PLANNER™ designation and the ACCREDITED WEALTH MANAGEMENT ADVISOR™ designation from the College of Financial Planning.
